Under the Tennessee Asbestos hazard Emergency Response Act, school systems are required to keep reports regarding asbestos removal. Although the statutory regulation at 40 C.F.R. 763.94 provides that the management plan records shall be maintained for a period of three years, the management plans are historical documents referencing the management of identified or discovered asbestos in a school. Because the plans may be updated in stages, the management plans should be kept as long as a building is being used as a school building. Therefore, it is necessary that all documents related to the management plans be retained as long as the building has not been demolished.
